An insight on Matrimonial Causes : Celebration of Marriages(Venue)

How and where can marriage be celebrated and by whom under Nigeria Law(Act).

  1. The registrar of the marriages has been accorded a wide range of power to preside at a marriage ceremony and issue a certificate to the spouse of such marriage(see S. 27). It is called Registry /Court Marriages. 
  2. Marriage may also be celebrated in any licensed place of worship by a recognized Minister of the church, denomination with the rites or uses of the marriage observed in such places. But with open doors between the hours of 8am-6pm and in the presence of two or more witnesses besides.
  3. Although,the production of the original or certified copy of a certificate of marriage is the best recognized method of proving a marriage under the marriage Act, however non production of the said document is not an indication that there was no valid marriage on the Marriage Act.  See Christopher Anyaegbunam v catherine Anyaegbunam (1973)1ALL NLR (pt 1) page 385 @ 386
  4. Inaddtion,where there is evidence of a ceremony marriage having been gone through followed by the cohabitation of the parties, everything necessary for the validity of the marriage will be presumed in the absence of decisive evidence to the contrary, even though it may be necessary to presume the granting of a general license... This was held in Mrs. Bridget Motoh & snot v Emmanuel Motoh (2011)16 NWLR Or 1274,474 at page 526.
